
The ACWL would like to invite you to attend a seminar on the Appellate Body report "United States – Continued Existence and Application of Zeroing Methodology", circulated on 4 February 2009. The report deals with the continued use of zeroing in administrative reviews of antidumping orders in the United States. However, it also addresses many interesting issues other than the question of the WTO-consistency of the zeroing methodology. For example, it addresses the question of whether "ongoing conduct" can be challenged in WTO dispute settlement proceedings, the issue of "permissible" interpretations under the standard of review of Article 17.6(ii) of the Anti-Dumping Agreement and the review of evidence by a panel. The report also contains a concurring opinion with respect to the concepts of "dumping" and "margins of dumping".
The seminar will be presented by the Executive Director and ACWL lawyers. It will take place on Tuesday, 24 February from 13:30 to 15:00 at the ACWL's premises. A light lunch will be served from 13:00 to 13:30.
